H.R. 4310 & H.Res. 840 – defense authorization going full steam

Today was a busy day for the House of Representatives. Even as plans to bypass the fiscal cliff stalemate were being proposed, actions directly affecting the 2013 government spending were being enacted.

H.R. 4310, NATIONAL DEFENSE AUTHORIZATION ACT FOR FISCAL YEAR 2013 (NDAA), was addressed and passed in the House in May 2012 and by the Senate in December 2012. But the versions passed by each part of Congress differed – notably in reference to the ability to detain US citizens indefinitely, which the legislation states is not possible but which some groups believe effectively allows to occur (especially for those that are non-citizens on US soil). That provision, the Feinstein-Lee Amendment, was dropped in the H.Res. 840 version.

Overall, the NDAA for 2013 authorizes $552 billion for national defense and another $88.5 of overseas operations. Included in these funds are an increase of 1.7% to military pay, allows for abortions in the case of rape, incest, and danger to the life of the mother (which is an expansion on current law), continues to fund operations in Afghanistan, supports the Israeli Iron Dome missile defense program, prohibits detainees in Guantanamo Bay from being transferred to US soil, and various military weapons programs.

Another key provision that some take note of is:

Asserts that the U.S. should be prepared to take all necessary measures, including military action if required, to prevent Iran from threatening the U.S., its allies, or Iran’s neighbors with a nuclear weapon and reinforces the military option should it prove necessary.

The total cost of the NDAA is $1.7 billion more than President Obama requested. The difference, on a national budget level, is slightly larger than an accounting error and essentially not meaningful. Still there was a threat of veto, even though this is a bipartisan Bill in each part of Congress. President Obama objected to the prohibitions on the detainees of Guantanamo Bay, and thus threatened to veto the Bill.

That’s where the action today addressed the issue. H.Res. 840, the effort to match the House and Senate versions of the NDAA of 2013, rolled back the prohibition on the detainees to just a 1 year ban – essentially extending a similar provision from 2012. This change is expected to bypass the veto threat and allow the Senate to vote to approve the changes and pass the Bill potentially as soon as Friday. Remarkably, this means the Defense appropriations would be passed on time – a bit stunning even if the fiscal cliff debates were not concurrent with this action.

While not as wildly bipartisan as the Senate version (which passed the Senate 98-0) H.Res. 840 did garner 11 Democrat votes in addition to 232 Republicans to pass. Votes against were 2 Republicans and 175 Democrats. 6 Republicans and 5 Democrats did not vote.
